Terms of Service

These terms govern your access to and use of the Privacy Hood protocol, website, hosted interface, and card product. Please read them carefully — by using Privacy Hood, you agree to them.

Acceptance of these terms

By accessing or using the Privacy Hood interface, smart contracts, or card product (collectively, the “Service”), you agree to be bound by these Terms of Service and by our Privacy Policy. If you do not agree, do not use the Service.

Eligibility

  • You are at least 18 years old and legally able to enter into these terms.
  • You are not located in, and not a resident or national of, any jurisdiction subject to comprehensive sanctions, and you are not on any sanctions or restricted-party list.
  • Your use of the Service is permitted under the laws that apply to you. You are solely responsible for compliance with your local laws, including tax obligations.

The Service

Privacy Hood is a non-custodial privacy protocol on Robinhood Chain. It lets you send and receive USDG (and, over time, other supported assets) privately, and optionally convert USDG into a prepaid virtual card. The Service provides software and infrastructure; it does not hold your funds, act as a bank, a broker, a money transmitter of your custody, or a fiduciary.

Non-custodial nature; your responsibility

  • Your keys, your funds. You alone control your wallet and private keys. We cannot move, freeze, or recover your funds.
  • Claim tokens are unrecoverable. Certain references (such as claim tokens and redemption codes) are stored locally on your device and cannot be regenerated by us. If you lose them, the associated funds or card may be permanently inaccessible.
  • Transactions are irreversible. Blockchain transactions are final. Verify every address and amount before you confirm.

Fees

The Service charges a transparent fee on private sends and card purchases, quoted before you confirm. A portion of protocol fees is used to buy back the $PHOOD token on Robinhood Chain and send it to a burn address, permanently removing it from circulating supply. Network (gas) costs and any third-party issuer costs may also apply and are reflected in the quote where possible.

Cards

  • Cards are virtual prepaid Mastercard® cards issued by a third-party card issuer. Card value is limited (currently $1–$99 per card) and availability varies by region.
  • A card is delivered as a redemption code or link. Spending an open-loop card may require a one-time activation with the issuer, subject to the issuer’s own terms.
  • Cards are for your own use and may not be resold. Prepaid card value is generally non-refundable once issued. We are not the card issuer and are not responsible for the issuer’s services, acceptance at any merchant, or activation requirements.

Acceptable use

You agree not to use the Service to:

  • violate any applicable law or regulation;
  • launder money, finance terrorism, evade sanctions, or process proceeds of crime or fraud;
  • facilitate the sale of illegal goods or services, or any activity that harms others;
  • interfere with, attack, or attempt to gain unauthorized access to the Service or its infrastructure.

Privacy is a legitimate right; it is not a license to break the law. We may restrict access to the hosted Interface where required, though the underlying smart contracts are permissionless.

No financial advice

Nothing in the Service is financial, investment, legal, or tax advice. $PHOOD and any tokens or assets referenced are not offered as investments, carry no guarantee of value, and may lose all value. Do your own research and consult your own advisors.

Risks

  • Smart-contract risk. Code may contain bugs or vulnerabilities despite review; use is at your own risk.
  • Chain and infrastructure risk. Robinhood Chain is new infrastructure; outages, reorganizations, or relayer downtime can delay or affect transactions.
  • Regulatory risk. Laws affecting privacy protocols and digital assets are evolving and may change how, or whether, the Service is available to you.
  • Irreversibility. Mistaken or fraudulent transactions cannot be reversed.

Intellectual property

The Privacy Hood name, logo, and website content are owned by Privacy Hood or its licensors. These terms do not grant you any right to use our marks without permission. Open-source components remain governed by their respective licenses.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of liability

To the maximum extent permitted by law, Privacy Hood and its contributors will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of funds, profits, data, or goodwill, arising from your use of or inability to use the Service — even if advised of the possibility. Because the Service is non-custodial and largely free to use, our aggregate liability is limited to the fees you paid us in the 3 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Privacy Hood and its contributors from any claim or demand arising out of your use of the Service, your violation of these terms, or your violation of any law or the rights of a third party.

Changes and termination

We may modify these terms or the Service at any time. Material changes will be reflected by the “Last updated” date above. We may suspend or restrict access to the hosted Interface at our discretion. Continued use after changes constitutes acceptance.

Governing law and disputes

These terms are governed by applicable law without regard to conflict-of-laws principles. Any dispute will be resolved on an individual basis; to the extent permitted by law, you waive any right to participate in a class action. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
